To be arrested for DUI, you had to fail a series of field sobriety tests. After wards, you are required to submit to a chemical test, either urine, breath or blood. If you choose breath, then the Officer had the results right then and there. If you chose either of the other options, then it will be weeks before you or the police know the results.

If your BAC was below the legal limit, you could still be considered DUI. This is based on driving patterns, and the results of your field sobriety tests. If you had no alcohol in your system, and BAC of 0.00, and no drugs in your system, I am confident the district attorney would drop the charges.

It is hard to believe that you were arrested for DUI, and passed all of your FST's and passed your BAC test, with no drugs or little alcohol in your system. My guess is that you probably drank more then you thought, and felt just fine. You probably waited a couple of hours since your last drink and decided to drive because you felt fine. Unfortunately, this is a common effect of alcohol. Drunk driver often believe that they are fine to drive or believe that they are sober, when in fact, they are not. It is not a coincidence that your fine motor skills diminish with every alcoholic drink you consume. You are ALWAYS more impaired than you think. Next time the D.D. shouldn't drink at all.

did you take a Breathalyzer test? if not then they can say you were drunk. and if you did take the test then you were drunk. you must face the music and cough up the money for the fines. and thank God that you did not kill any one. l do not see why they would charge you that if there wasn't no reason. the policeman had a reason to pull you over. but if you were the designated driver, then what are your friends saying about it. will they go to court with you on your behave.

If you were arrested for drunk driving, I have to assume a field sobriety test, breathalyzer, urine or blood test was performed on you. If so, you were arrested for failure of one or more of these tests. If not given to you, or if they were and you passed them, get yourself an attorney and fast, for it looks like you have a case for getting the charge dropped. Good luck.

In my experience, most "designated drivers" are just the person who drank the least during the night.

Don't forget, you can be high or have taken medication and still be arrested for DUI.

So just to get it straight: You're saying the cop in this case risked his entire career, his house, and jail time to lie about your case just to make a measly misdemeanor arrest?

unbeilvable as is may seem the same thing happened to me--i went to the party where everything was going on-whiskey, beer champane--but i was drinkink tea-just got off work--so i told my buddies to stay put and i would get them home, so on my second trip the cops showed up & took us all to jail--well, ipitched such a fit at the bookin desk that the sgt. came out & i told him what happened & he made the cops take me back to my car-bottom line is to stand your ground-any judge would be proud of what you did--keep up the good work--sometimes the cops think you are guilty by association-like how can i(or you) be sober with a car load of drunks?go on the offense,sue them for false arrest

Next time, buy a keyring breathalyzer and take it with you when you go drinking

get yourself a good lawyer, and if what you say is true and you passed the breathalyzer and field sobriety tests, you should be fine.
