I've been in US for more than ayear. at first i lived in San Jose, CA. Then moved to Brooklyn Park, MN. And finally drove back to Wesminstaer, CA. I cannot remember exactly the day we came back here. So how can i know if currently I'm a resident or not and how to proove that? One more think I want to ask is am I eligible for FAFSA if I'm not a resident yet?

US Residency is determined not by how long you have been living in the US but rather by whether or not you have a green card. I have a social security number and I have lived in the US for 2 and a half years now, but that doesn't 'legally' make me a US resident because all that time I have been here I have been on a work visa.

Furthermore, when you are an american citizen, or US resident (i.e. you hold a green card) then state residency of a particular state is determined by the amount of time you have lived in that state (it varies by state). In other words, if you were born in Texas, or aquired your residency (green card) while living in Florida, but you are applying for resident tuition in North Carolina, that would be determined by a) your citizenship or residence (green card) and then, by the amount of time you have lived in North Carolina.

So, if you do not have a green card, you are not a resident of the USA, and if you hold neither residency or citizenship of the USA, then, you are not elegible for FAFSA (because you are either here on a visa or illegaly, both which don't entitle you to federal benefits or aid). Also, if you are a citizen or resident of the US (green card) but you haven't lived for a certain period of time in the particular state you are applying for state funded financial aid, then you do not qualify as a resident of that state either, and thus you would have to pay out-of-state tuition.

What I would reccomend you do is that you apply for fin-aid that is privately funded. Those awards are granted regardless of residency or citizenship. Also. talk to your school counselor, they might be able to help you out or point you to other fin-aid sources.

Do you have an I94? Basically it is what status you came into this country on if you are a eligible noncitizen or not. If you came here on a student visa you are not eligible but as you state you have a green card you just might be. Complete the FAFSA and speak to your financial aid counselor and admissions contact to see if you qualify or not they will let you know what documents you need and if your status is one that is eligible.
