Since India is a Democratic Country the law makers try to give opportunities to the criminals for a change to good human being and hence minimum punishments are given. But it works in the other way here.

The criminals do not have real fear because they will not get
severe punishments like Saudi Arabia and other countries. If the
punishments make fear in the hearts of criminals they will never try to continue as criminals.

Nothing is unchallengeable (not sure about spelling). But not every judicial system or government is perfect. There are flaws in all of them. It can be changed though, all it takes is to challenge the authority and once more and more people take that action, they will be forced to do something. It can be somewhat related to Rosa Parks not giving up her seat and the rest of the black community boycotting buses.
