Sorry I should have elaborated. We haven't seen each other in 3 years after seperating and to say it ended ugly is an understatement. The last time I saw him he was being arrested {LONG STORY} and he refuses to answer the phone or any correspondence, don't you think if it was that easy I'd have done so silly? ;)

As far as the last answer, we had nothing. No kids no rental at the time no home nothing, nada, nil. I have gotten away with filing single the past two years and IRS never said anything, I don't know if that's because we hadn't lived together or anything not sure of the stipulations, but I need the refund money in a bad way this year and don't want anything to screw it up. Maybe the real question is, is filing single legal according to the IRS?

As for the last answer {again} he abused my child and thats why he went to jail. Real winner yes I know. The fact that he always works under the table so to speak and never pays taxes also concerns me.

BTW we were only together 3 months when this happened so we never filed anythign together. I have waited a long tiem to divorce him as well because...long story but I think this question is hopeless or I would ave figured it out by now.

That's the thing I HAVE NOTHING TO GAIN but using him and didn't know if I even had to. I was just told that the first time I tried it so I went elsewhere and filed single back then.

Oh yes and I have not filed divorce yet. {WHich will be an absolute simple divorce as we have no real estate or children...just sign here kinda thing} Why do you think I need my tax money?

The oast two eyars I have not said anything about being married when I go to file and just filed single. Didn't know what else to do. I am jsut not sure if I HAVE to ahve his social in case I get audited {like if the IRS realizes I am married, will they say I have to file married filing seperate, which I would in fact need his social}

I don't know about the marriage license, but my certificate does not have it on it, just our dates of birth.

If you are in the process of a divorce and attorneys are involved, they can compel him to file a tax return. There is nothing that states you must file jointly; however, he needs to provide information that would not hinder you.

If you can not locate the information file a return as a married person filing separately. A tax adviser can assist you.

You mention that he had abused your child, so sounds like you have one although apparently from a previous relationship since you also say that the two of you have no children.

If you have a child who lived with you over half the year, you provided over half of the expenses of maintaining the home, and the child is your dependent, then you are allowed to file as head of household under the "considered unmarried" provision since your spouse didn't live with you at any time during the last half of the year. It's legal if you qualify (see IRS Publication 17, chapter 2, or instructions for 1040), and the tax rates are cheaper than single.

If you have not co-habitated with him for the last three years, then you can file Single/ or Head of Household if you have any dependents.

File your taxes girl. What did you do the past 2 years?

If you are worried contact a firm that will give you free tax advice, make sure the person you are speaking with has credentials.

You don't have previous years' tax return(s)? No old joint account info? Divorce decree? Nothing? Guess you'll have to do it legitimately then, on your own. I'm sure there is a reason why you're not just asking him for it so ya'll can file jointly, get more money, and SHARE the wealth, hmmm?

You could request a previous year's tax return from the IRS which may have the information you need.

If you have to be sneaky about it:

If you own a home: Get a copy of the documents from the title company saying you need it for the divorce.

If you rent/lease: Get a copy of the lease/rental agreement from your landlord.

If you've been separated over 1 year, you cannot use his social AND you cannot use his social even if you are together unless he signs it also .
Soooo you real goal here is to run some scam BUT
It would backfire and you would end up doing time !

Try to ask him by an intercesor (a friend of him maybe). If not there maybe legal procedures in your location useful for that

his SS# should be on your marriage liscense...(if you don't have a copy the state/city/county in which you married will)
