Technically, illegal aliens are enemy combatants and don't have rights in America.

So that being said, is it a crime?

Approximately 27.5 percent of all federal prisoners are criminal aliens (illegal aliens and legal aliens who are convicted of committing a crime). (Read more: Information on Criminal Aliens Incarcerated in Federal and State Prisons and Local Jails GAO)

America is at war with Mexico. Mexico is encouraging its people to invade the U.S. Mexican illegal aliens are clearly enemy combatants under U.S. laws.

Not in Texas. At least Texas doesn't discriminate on who breaks in, skin color and nationality along with gender makes no difference, they can be shot.

Illegal aliens are not enemy combatants unless they are from a country that we are at war with.

If anyone, legal or not, breaks into your house you have the right to defend yourself. Are you really going to stop a home intruder and ask for residency papers? If you did, do you think a home intruder is going to stop and provide you with his identification? Many states allow you to shoot an intruder without criminal penalty. The shooting will be investigated to determine whether or not a threat existed or the break-in story is a cover-up.

The legal status of a home intruder committing a crime is irrelevant.

A Person is a person. THAT being said...
The incident will be treated ther same as if the intruder were an American. Meaning Mexican American, African American, Polish American, Native American, Crackhead American, Gay American, Etc.
Think of violating a written contract with an Ilegal...they can still tyake you to court for damages. We extend our laws to everybody within our boundaries (at least in theory and not those with diplomatic immunity or enough cash to do whatever they want). Any time you do something that takes a life be prepared for criminal and civil actions. People always seem to think you can kill someone in an act of protection, life property etc. you may have to prove it.

Well do you have a gun legally? I'd hate for you to go out of your way to get a guy to break into your home so you can shoot him, then end up going to jail because you have an illegal firearm.

Ok.. was going to give a legal answer that it doesn't matter if the person is legally in this country or not, what matters is what state jurisdiction the property is in but......

BLOTS ANSWER IS NOT ONLY HILARIOUS BUT THE MOST LEGALLY CORRECT!!!! lol...

and where the heck did you come up with the "Technically" they "are enemy combatants", unless they are Taliban that does apply OR unless like Blot answer implies they are trying to take over earth... ok.. still laughing at her answer.....

Unfortunately in most States, if you shoot any intruder, you had better have been in fear of your life and threatened with bodily harm....or the bad guy will sue you besides.
