Depends. Did the kids live with him during the last year? If they did, how long? If the kids never lived with him, then NO he cant file claiming a kiddo. My ex-husband tried and ended up getting audited and paying the money back. This was partly cause I filed claiming them too; they lived with me all year. But, if the kids lived more than half the year with him, then he can claim them.

yes he can and only 1 parent can claim the children..my one friend is divorced and has 3 kids so she claims 2 of them on taxes and he claims one..one year she claimed all 3 and he did the 1 like always and she got in a small bit of trouble with the irs for this and had to pay back taxes on it

Depending on what state you live in probably yes. However, if you are head of your household, you may be able to claim them on yours too. Please consult with a tax person to get a definite yes or no on this. But you should be able to.

he is able to claim the payments he makes to you for the kids but he cant claim the children

Not unless you give him a release to claim them. He can't claim his child support either.

Nope, he may claim his support payments but not the child.
