The visa holder can request a waiver, but it has to be for a very good reason and can take months to be approved even then.

Remember, you agreed to go home again when the US government or your own government offered to sponsor your work in the US. You really should stick to the agreement you made.

Yes, but I'd really think about it before you did it. If you are granted a waiver, you CANNOT extend your J-1, nor can you transfer schools. As of November of 2006, a new 2 year bar was implemented for J-1 scholars that doesn't allow them to come back in that same category for 2 years, regardless of the 2 year home residency requirement. You need to keep this in mind. The only real reason to apply for a waiver now is if you plan to change to an H-1 soon.
