Write i have a friend who is currentley in prison in this country and he is a asylum seeker from africa sri leon he has lived in this country for seven years now and we want to no if he will be straight deported back to his country on release but he is still currentley in prison after he has finished his sentence, under immigration regulation and i wanted to no if he is suppose to be in prison or a immigration centre

Let me get this right, the guy is a criminal invader, illegally in my country. He is in prison?

I should hope they ship his law breaking *** back to whence he came promptly.

As the wife of a LEGAL immigrant, I have no patience for criminal invaders who break the law.

If "this country" refers to UK, then most likely at the end of his sentence he will remain in custody until he can be deported back to Sierra Leone. I am assuming that he has been convicted of a criminal offence, in which case he would serve his time in a normal prison. At the end, he may remain there, or be transferred to an immigration removal centre.

If his claim for asylum has still not been resolved, that would need to be decided before he could be removed. You need to get legal advice - in the first place contact the solicitor that dealt with his criminal matter, but he may not know much about immigration. If that is the case, you need to find a solicitor that specialises in immigration.

By the way, previous answerers have said he is here illegally. If he is claiming or been granted asylum, he is NOT here illegally (though evidently he has done something illegal while he was here - guess what, lots of natives do that as well!)

Too bad your question is not well worded. If your friend did criminal activity, he'd be in a regular jail. When the officials are ready to deport him, he may be transferred to an immigration jail. The only way he'd be deported is if Sierra Leon will finance his trip back. The US government doesn't really keep a budget for airline tickets so the process is long. He might very well spend many years at the immigration center waiting for that approval to come through.

I think you are saying that your friend is in prison due to immigration law - you want to know if he should be in prison or an immigration centre? I don't think it matters where he is does it - either he is in prison for an immigration offence or a criminal offence on top of being an illegal immigrant. I suspect you want to pursue his placement to be in an immigration centre with Legal Aid?

You have to be realistic, whatever he is in for he has broken the law, therefore it would be realistic for him to be deported, or at the very least held in custodial sentance - or is he expecting hotel accommodation and freedom? He should be deported in my opinion as he hasn't exactly started off on a good footing in his desired new home country has he?

He should be deported if he is here legal or not if he breaks the law then well there is enough people here who break the law they don't need more from other countries doing it.If he claimed asylum then he didn't want to go back to his country in fear of danger so its OK for him to come here and break the law?what did he do exactly?im not being racist but you cannot expect to take someone out of a country full of war and violence and expect them to be civil they have lived with it their whole life some would kill you over a pair of shoes,so they feel they can behave n another country the way they would in their own and this is highly unacceptable.

Your friend should take legal advice. Unless he has been granted Legal Asylum then I believe he will be Deported. If He had lived here for over 10 years without any problems then he should be given a settlement visa even if he was here as an illegal.

If he's in prison already, I doubt he'll be able to remain in this country even if he applied for asylum. There's no way he can get permanent residency with a criminal record.

He should of been deported immediately, instead we are paying for him to stay here. You come to England then you damn well show it some respect. I hope they throw him in the sea with a polystyrene float and point him in the direction of Africa.

So he's a criminal for being here illegally and he's a criminal for something else. Do I have it right? You think he deserves to stay here? You think that we WANT him here.

I hope they boot his sorry butt out of here the minute that he's released from prison.

Hopefully he`ll be deported. He`s not only an illegal, but a criminal as well? We don`t want that sort.
