My old high school friend (she has had a hard life) was convicted of 5 narcotics felonies and 1 felony for welfare fraud. She was sent to Chowchilla Prison for women for 2 years for the drug charges (2 years for each of the 5 convictions, should be 10 years, however they are to be served concurrently). In addition she got 8 months for the welfare fraud, to be serve consecuetively. How much time will she most likely serve? 2 years and 8 months--because of the concurrent sentencing OR 1 year and 4 months (50% of the time off for good behavior--if she does indeed behave well in prison--this is her first time in prison, she is 34 years old with 3 kids under the age of 18)? Thanks for your help.

If she completes a drug rehab program in prison they may consider her for parole after a year. Typicall the 50% for good behavior is for more serious offenses and is 50% off the FULL sentence (10 years, 8 months, whether ordered to be served concurrently or not). Im assuming a court appointed lawyer in this case and the children with Child Protection or whatever they call Juvenile Services in CA. If so, reuniting these children with their rahabbed mother is in everyone's best interests, to reduce and the financial and support burdon on the state as well as any further seperation trauma to the children.

She will have to attend meetings and go through Re-Hab sessions.
If she does good and acts right she won't do even a year.

Now here's the thing, if she ever gets busted for Conspiracy to traffic or possesion of Methanphetamines..she will do Federal time and get 20 years to be served straight until all 20 years are done.

Even though, she doing State time right now, it will go federal next time. She must wake up and smell the Coffee.
This is her only last chance to do right and walk straight.

With good behavior and rehab programs, she could be out in 6 to 9 months
