Now were up to day 17!!! Refusal to refund, item bought of internet! Advice please - is this a trading standard issue?

If you have paid for next day delivery the least they should now be doing is refunding you for the postage of a service you have not received. Personally I would say this is completely unacceptable get on the phone to them stay ultra calm cool and collected and refuse to terminate the call until you have got to a manager it never hurts to say that if the manager is unable to resolve this in a satisfactory manner then you will be reporting him by name to the trading standards peeps to see if that makes them buck their ideas up. You are well within your rights you have paid for this and not received it. Give em hell best of luck

The law doesn't define what is a "reasonable time"

Sometimes postal items say "allow 28 days for delivery".
But if you've been promised next day delivery then 17 days does seem a long time.

I'd write to them demanding either the goods or a full refund within 7 days. Tell them if neither goods nor refund are received by xx/xx/07..... (7 days time) you will take action in the county courts for the return of your money, together with costs and interest, under the County Courts Act 1984.

If you pay for something that doesn't arrive you are legally entitled to a refund. If you paid for a guaranteed service, then they don't really have a leg to stand on. You need to give more detials about where you bought it. Don't waste your time with trading standards. If they wont refund you, its basically theft because you dont have your item.

Was it ebay? if so contact ebay's resolution centre. See if you can find the sellers address, you could always pay them a visit.

There is no trading standard rule to say after a certain amount of days its unexeptable but you will be able to claim if its over what they said it would take. Did they say how long it was going to take?? 28 days is usually the max but it matters what it is. I hope your item comes soon.

They have failed to deliver as per your agreement, while I would give an extra few days for delivery, however 17 seems excessive and you need to contact the seller and inform them you are not prepared to wait any longer, they have failed in their duty to supply the goods, also inform them that you are going to contact your credit card company and request they act on your behalf to claim your money back.

Do you have proof that the item was dispatched, and do you have a tracking number, and the name of the courier firm???

hell yeah! any reasonable vendor wouldve slammed it in a taxi by now!!!! i cancelled a 'non cancellable loan and ended paying less than id borrowed cos they tried screwing me over,citizens advice first stop dude!,also if you paid with Credit card you can sue them for it if necessay,
