I still have not received my P45 from my old workplace, its been a month.

They are telling me that I willg et it from the TAX OFFICE, the tax office are telling me it is the employer that will send it.

I have filled in a P46 with the new workplace.

Will I get emergency taxed still?

You will be on emergency tax (503L W1 or x) until P46 is processed.

Once this P46 has been processed a cumulative tax code will be issued to your new employer with the previous pay and tax IF there are no gaps in your employments from 06 April 2006 to date and the Inland Revenue has received all your previous employments P45s.

Be pro-active, call the Inland Revenue and ask what information is required to enable a cumulative tax code to be issued.

There is an idiot at your 'old' employers who thinks you want your emergency code altering to your proper code. Do you understand the way this idiot thinks incorrectly what you 'need'.
You have been given some good answers and I repeat that your previous employer MUST give you the P45. It's like your Rail Ticket before you start a journey. It's the old Company's record of what they have withheld from your pay in the form of Tax which they have to pass to the I.R.
Makes you think they are using your Tax money for working captial purposes because they are not making any profit or don't have any cash in their till.

Yes you will.

A P45 is what your old employers MUST give you within a WEEK of leaving.

Inform the Tax Office that your old employers are being difficult and suggest they may be having financial difficulties or trying to avoid paying all the Tax they are required to pay.

yes, but you will get it all adjusted once your new employer get the correct tax code from the tax office. and as emergency tax is week one single person and you were obviously employed before, it is not going to be that different to what you are taxed now, so stop panicing

Your old employer is responsible by law for sorting out your P45. Get onto them as a matter of urgency as you may be paying the wrong amount until it is sorted.
