I wouldn't bother sueing someone because of that. America is just getting to "sue-happy." Just ask it be taken back and ask for something else. Chances are, there was no way for a lizard to be sent out to the public. It's the expediter's job to inspect all plates before they are served to the public. And us cooks would notice something like that. Unlike those fast-food people who wouldn't notice a breaded chicken-head from a wing.

But seriously, people sue for pretty much anything these days, so suing for something like that would probably be more than plausible. That's not to say that you'll win the case, or get any money out of it, though.

Ignore yitgowa's answer.
She is in the "food industry" and thinks whatever
you serve must be legally ok (they are evil). You can sue for a place
putting lizard in your food.
