It depends on the circumstances. Technically, it is battery on a police officer. If you weren't defending yourself against an assault, or of the officer was not in uniform and didn't identify himself as a cop, you might get off. If it was a uniformed officer, especially if they were performing their duty, you might get as little a a few days if he doesn't press charges, or if the judge feels there were extenuating circumstances. Otherwise you could get the up the the maximum punishment for assault on a police officer -whatever that is in your state. I would think not less than 30 days, and perhaps as much as a year.

In CA, you're looking at Battery on a Peace Officer, a violent felony. Punishable by 2, 4 or 6 years in State Prison. So go ahead and try, after the officer defends himself, and you get out of the hospital, then you get to look forward to Prison! Have fun!

there is no set number of days for any criminal offense...

what you are talking about would be considered assault on a police officer.... in the state of ohio (where i am answering from) this can be found in the revised code 2903.13a3

it's a fifth degree felony and punishable by no less than one year in a state correctional institution (also subject to a fine of no less than $1,000 and probation).

every single state has a different code for their law, but most of them are similar....

bottom line is you're looking at a minimum of a year if charged and convicted...

even for a simple slap.

you are in allot of trouble , consider prior offenses for any crimes you've been convicted of ,circumstances may make a difference , the state you live in. Invest heavily into a good criminal attorney you are in a bad place don't think this is a small problem the jails are full of guys who just made a stopped mistake a good attorney will try and make a plea bargain to a lesser charge its gona cost you big anyway you look at it freedom is precursors don't give it up easily and learn to keep your hands in your pockets (one who learned the hard way,)

the courts usually dont like the whole assult on a police officer. depending on the situation your looking at 3 yrs and up depending on the other charges (unless you just decided to walk up to a cop and slap him/her)

If you are a movie star .. not many, if any. Just community service and a warning. If the general public does it (?) .. Then it depends on the State, the City and the County that it happened in , and, of course, the judge. I'm not sure if it is considered "assault" or not .. but to assault an officer of the law carries heavy jail time and heavy fees. Good Luck !

In the state of Iowa, you would get 5 years for assault of a peace officer. (Federal Offense)
