WHAT CAN I DO IF MY EX-BOYFRIEND IN 1997 TOOK MY CHILD FROM ME AND I CANT FIND HIM AGAIN! I FOUND HIM IN 2003 HE PROMISED TO LET ME GET MY SON BUT HE DIDNT BRING HIM TO ME. I NEVER SIGNED ANY DOCUMENTS OR ANYTHING, BUT HE HASN'T LET ME HAVE ANY CONTACT WITH MY SON. I TALKED TO THE IRVING POLICE IN TEXAS BUT THEY TOLD ME IF WE WERE MARRIED I HAVE TO TAKE HIM TO COURT BUT I WAS NEVER MARRIED TO HIM, I HAVE BEEN IN PAIN ALL THESE YEARS I DON'T KNOW WHAT TO DO, I CAN'T AFORD COURT COSTS, I JUST WANT MY CHILD BACK! WE WERE TAKING TURNS KEEPING HIM AND THE DAY HE HAD HIM HE TOOK HIM. I DONT KNOW WHAT TO DO PLEASE HELP, I JUST WANT MY CHILD. ANY ADVICE?

If there was no agreement on visitation or custody then you will have to take the turkey to court. once you have filed the petition in court then you can force him to appear. failure would get him held in contempt and thrown in jail. if you do have an agreement or custody arangement then you can file charges with the AG offices. if he has left the state you would be able to file those with the federal district attorneys office. it is all about the paper work basically. if his name is on the birth certificate and you have no written agreement then you have to go to court. check if your state has a legal aid service, they may be able to help you get a lawyer cheap, or even free.

Contact Missing or Exploited Children, a national group that will either help you or point you in the right direction. You also can go to family court and talk to a child advocate about what to do. You don't have to be married to take this guy to court. Call and speak to a juvenile detective with the police department. Keep calling until you find someone who will help you. Get in touch with a domestic violence shelter and ask for referrals. Try Rape Crisis. These groups have lists and lists of other charity organizations and could refer you to one. All advocate groups network, so someone will know where to send you. All you have to do is find that one person who is willing to go an extra mile for you, then you are in. Go back to the police department and ask for their victim advocate. Help is out there, but you have to keep looking. Good luck to you and don't give up. If you were in my state, I do believe I could make a kidnapping case against the guy. Again, my best wishes are with you.

Why haven't you gone to the Police? I think you are leaving out some important facts, but I'm sure you have your reasons. If you have the childs birth certificate & you have your own to prove who you are, then you will have to go to the Police first to start an investigation into this matter & let the court system sort it out in the "best interest of the child". You may have a long fight on your hands that will leave your child in a worse state then before he was taken from you. It would be traumatic to just take him away from his Father & it could hurt him worse than it hurts you to go without him in your life, so please approach this slowly & safely, so that you don't cause your son needless pain. Surely, the court can mediate some sort of a custody arangement that benefits all parties involved. Good Luck & please be patient & fairer to him than he was to you because he is still the boys Father, regardless of what a jerk he is!

isnt that classified as kidnapping? i thought you should have the only parental rights to the child since you were never married. if you never had an agreement that allowed him to keep the child, i think you should ask the police again about it being kidnapping charges.

just an opinion from what i have seen. good luck. have you ever talked to an attorney? or the county prosecutor? i would if in your shoes

I think you can file papers with the court for custody even without a lawyer. When he does not show up for court they will probably put out a warrant for him. I think! Good luck to you!

Go to the district attorney. Tell them the whole situation. If they can't help (and i think they can,) they should be able to direct you where you can get the help you need.
