This person with 0 feedback advertised a Hermes Birkin for cheap and I bought into it. Well, you can guess the rest. I received a completely different merchandise from what was advertised. Paypal and Ebay don't care. Actually they are being charged back by American Express so they try to protect their money by protecting the seller. Do you think I should file charges against this person with the police? File a small claim with the court? Is there a law protecting the consumer? Has anyone have this experience and do you have any advice for me other than to "learn a lesson and let go"? Thanks.

Although you legally could pursure civil, and possibly, criminal action against the seller, the probability of reaching a good outcome is slim.

I have spent the last four years as a detective working on all types of cases, several being EBAY and computer fraud type cases. These cases often involved buyers and sellers in different states and/or different countries. Local law enforcement is often unable to complete investigations of this type and the federal agencies who, in theory, are responsible for these types of investigations will not take them on unless they are on a huge scale!

When it comes to suing, you would need to find the true identity of the seller who defrauded you and get them served into court. It is very unlikely that you would be able to get that far successfully as these professional con artists are pretty good at what they do. They often work through PO Boxes, move regularily, etc. Even if you got all the way of winning a judgement against the actual suspect, you would probably never see a penny from them.

You should probably write this one off to the lesson of "If it seems too good to be true...."

Sorry to hear this. I never had a problem on Ebay, but, worry this happen. I figure it did from some of the Feedback I have read. I not sure you can sue, I mean, you can take them to court, but, this what "THEY" will say; "I sent her what she ordered and now she just trying to get her money back and give me the different merchandise she "SAY" I sent her"!
Hope you understand. If, you did not open in front of the mail carrier as a witness, it basically your word against their word and it most likely a no win! I am sorry, maybe someone can give you better advice, but, I am afraid what I say, probably the way it is. The crap part is; if you give them bad feedback they do it to you. I think a seller should give feedback as soon as they paid. The Buyer did their part, they paid. Then it the Buyer's turn to leave feedback when the seller do their part.
I have sold many things and have ALWAYS left feedback as soon as I am paid. I feel this give the buyer an open door to say how they feel about my part. I have a 100% Feedback AND everyone I have sold to I have given 100% because they have always paid, even overseas!
