my mother-in-law is threatening us with suing for custody of my husbands son.........we want him and are willing to fight for him...........could she win?

short answer NO
longer answer. NO she would be the last person on the list for custody. if she where to somehow prove you to be unfit parents the state would take custody and place the child in foster care before they would take the off chance that she would live 11 more years to care for the child. when the court renders such a ruling they look at not only the health of the person now but the odds that the persons health will hold till the child is 18. that would place the in-law at over 90. sice the average human lives only about 80 years she is not going to be ruled as a fit gaurdian, unless the judge in the case was 95 and a senior rights advocate.

No, the courts would rather have the child in custody of the natural parents unless you are proven to be unfit parents...what is her problem, that is the most ridiculous thing I ever heard.

No, unless the boy was in a really abusive home and no one else wanted him.Even then she would have to be in really good health.

I doubt it but if she is in good health and could provide a stable healthy home then it is a possiblity
