My soon-to-be ex-husband and I seperated last April. He hasn't lived in my household since then and has contributed nothing financial to the household. We are not legally seperated nor fully divorced as of yet. We also live in New York. Can I file under the single status or must I file married but seperate?

If you have a child you can file as Head of Household. If you do not, then you are Married Filing Separate.

Do you have a child living with you or not?

If you have a child, and you pay over half the household expenses, then you may be able to file as Head of Household.

If you do not have a child living with you, then you cannot file as Head of Household. Your only choices are Married Filing Jointly or Married Filing Separately.

Your filing status cannot be Single.

You must file as Married filing separate OR Married Filing Joint - UNLESS you have a dependent child living in your home. Then you may be considered unmarried and file as Head of Household .

Remember, if you both file as married filing separate and your spouse itemizes, you must also itemize.

You CANNOT file Single.

You can't file as single.

If your home was the main home of your child for more than half of the year, and you paid more than half the cost of keeping up your home for the tax year, you might be able to file as head of household. For the additional rules to be allowed to do this, see IRS Publication 17 (section on filing status, part on "considered unmarried"). Otherwise, sorry, you'd have to file as married filing separately unless you can agree on filing a joint return.

If the husband died in 2010, she might want to record a joint go back. After this 3 hundred and sixty 5 days, she files as unmarried, because she is no longer married, and she or he does no longer have a depending toddler.

I'm fairly certain that you qualify to file Single, Head of Household under the abandoned spouse rule.
