I am planning to claim my live in boyfriend on my taxes as a dependent, he did not work last year. He owes some back child support. Will my return be penalized?

More than likely you can not legally claim your live-in boyfriend as a legal dependent for income tax purposes but it will help to check the IRS definition of dependent and also determine if you have legally filed paperwork declaring each other as domestic partners. I am not sure if you can claim domestic partners as a dependent.
They cannot withhold part or all of your refund for his back child support that is due.

If he lived with you all year, you provided more than half of his support, and he didn't make over $3300, then you can probably claim him if nobody else is. Your refund would not be taken for his back child support.

There is of course a much more obvious question of how good a bet this guy is for your future. Something for you to think about.

I don't know if you can claim your boyfriend or not, but if you do they will not attach your refund for his child support. He would be a dependent on your tax return. If he were a joint filer on your tax return they would take the money because it would be partly his money. As a dependent it is not his money, his name is not on the check.

ask the person perparing your taxes.. or you could call hr block and they could tell you..i dont believe so sense he is a dependent but you dont want to take chances

it is possible and if you use his ss# you could be flagged for an audit in the years to come. tell him to get a job.
