So this tax season, we can claim money for this spanish-american war tax. its a tax that was put on long distance phone calls. I have had only a cell phone. can i claim this tax? do you think the irs would check my phone records?

Just to add some more...I am filing jointly with my husband, so I would be claiming 40$ for the tax credit, if i claimed it.

If you are claiming the standard amount ($30-$60), you don't have to prove anything. The IRS is willing to accept your word that you did pay it. This is basically a "freebie" by the IRS.

However, if you want to claim more, you will need to be able to substantiate your claim if you are audited.

To clear up misinformation given......yes you can claim the credit if you only had a cell phone. The IRS clearly states on their website that you CAN claim the credit if you had either a landline, cell phone, or VoIP.

They don't know. They trust you to be honest in reporting correct amounts. Many people do cheat on their taxes and that is the reason the IRS audits people and businesses.

If you are audited, you have to prove that you have paid the amounts you claim as deductions on your taxes by supplying copies of receipts, cancelled checks etc.

The IRS does not know anything. Their agents only question claims made by tax filers. It is the job of the filer to prove that the claim is correct or be fined or imprisoned for filing a false claim.

No you cannot claim the tax. And yes they will check. The form that is required to fill out for the deduction uses a calculated amount of tax based on 6 months of usage.

With all cheating, your rolling the dice on getting caught. If you are audited, which the IRS chooses randomly also, then you will have to find those phone bills and prove your claim.

No.. The most anyone can get back is between $30 to $60...The IRS doesn't care about that little amount of money.

Everybody gets $50 and you don't have to prove it. If you think you deserve more, you have to turn in the receipts, but the gov't will give you $50 otherwise on the honor system.
