I filed for social security disabiltiy at the end of Novemeber. I am already in the decision stage. I sent in all my copies of my medical records which were over 1000 pages. I had extra but the examiner said that I had sent in more than enough information and she did not need any more from me. 2 weeks later i went for mental exam. She called me and told me that I needed to see one of their doctors but did not have to do a full exam just a passive range of motion. I went to the doctor and he said that I had 0 range of motion in my neck. I am trying to think positive. I feel that if I was looking at denial of benefits that they would have made me do a full physical to help my case. I was in the doctors office for 20 minutes to do range of motion and left. I also sent in documents from my previous jobs showing where they were trying to do a fit for duty examination because my disability was affecting my job performance and also notes from doctors saying i cannot stand or sit for 30min.

Sounds like you will be approved, but the process is slow. Though most are denied on their first application, it seems that you have provided enough important information.
I was approved the first time, but as I recall, it took a while - but the benefits were paid retroactive to the date of my disability.
I do hope you kept, and are keeping in a safe location, copies of ANY medical records and correspondence with them. I'm a stickler for keeping copies and it's a good thing - I almost lost a whole years benefits just because someone at SSA made a "typo". Those records might also be helpful when you go for your next evaluation to see if you still qualify, especially if your original doctor is not available.

Good luck.... I'm sure, if like me, you would rather be able to work than collect SSA. A lot of people just don't understand.

I did not use an attorney. The key is to have ALL the pertinent information and to be sure you have worded everything correctly. Though, in some cases, an attorney may be helpful, it does not guarantee you will be approved. However, if denied two or three times, you might need to consider it.

Rachel gave an EXCELLENT answer - the details do really matter

Your chances are pretty good. The most important thing when applying is being detailed about your day to day limitations. Don't be ashamed to admit that most days you don't get up and shower, or that you have to have help to take a shower, wash clothes, whatever it is. Don't forget that side effects of medication count too. If you sleep 18 hours a day due to the pain meds you are on list that too. There is no such thing as too much information when they ask about your day to day schedule. It often helps to ask someone who lives with you or knows details of your situation to help fill out the paperwork, often times there are things that seem "insignificant" to us because they are routine or normal for us. If you are denied don't be discouraged, you can take this all the way up to the Administrative Law Judge. There are plenty of attorney's that will charge you nothing up front, the usual fee is 25% or your back benefits. If you are denied appeal quickly.

It is very rare that anyone is approved at first. It usually takes hiring an attorney. Sorry to be so glum, but the system does not give out benefits without a fight.

Get a lawyer. My son is challenged and will never get passed a 10 year olds mentality but SSI still turned him down TWICE. Once i got a lawyer they approved him .I didn't even have to go to court and the lawyer charged me nothing b/c they didn't get a chance to do anything.good luck and fight for your right.

I think the statistics are that 75% of people that apply get denied the first time. 50% get approved the second time, if you appeal. If you get denied, reapply, and the find a lawyer that fights for your SSI benefits.

You are in.

0 range of motion in your neck? Oh no doubt you will get it.

however, unless it is a permanent situation, they will probably reevaluate you at least once every other year.

i hope you get it...
i'm in the "appeals" stage of my case, which i'm told can take over a year.....ughhh....
i don't know what your "chances" are, but it sounds like you've done all you can....try not to worry about it, it will likely take a few months before you get your answer-that's a long time to stress out about it!
