A jaffa cake is defined as a cake.
It is all about how they go stale. Cakes get hard when left out. Biscuits go soft. Therefore a Jaffa cake is a cake (which is lucky as you pay more tax on chocolate biscuits!)

It's true. A cake is classed as a necessity but a biscuit is classed as luxury goods. So as to avoid taxation, Jaffa Cakes are indeed a cake.

Jaffa cakes are classed as cakes by HM Revenue & Customs. The way to tell cakes and biscuits apart is that Biscuits go soft when they are stale and cakes go hard

it has been called a cake because if it was classed a chocolate biscuit the manufactures would have to pay more tax. so it is purely financial that mcvities insist on calling it a cake
