Please do not guess at this answer - I'm looking for someone with genuine experience or Knowledge of this situation.

In '93 i was convicted of shoplifting - in 96 I went to USA on visa waiver travel.

in 99 applied for fiance visa and was refused due to convictions and misrepresentation at port of entry.

I have applied for and been issued so far with 2 visitor visas (over the last year) - of course to get that I needed a waiver for my ineligability.

My question is; If my wife and I decided to move to usa (she is us citizen) would the waiver of ineligability i have for the visitors visa be valid for immigrant visa?
