Been told he would have to go back to Zimbabwe to get spouse visa and this could take up to 6mths, (we want to get married this year), but this is not safe for him to return. Does anyone no a way round this where it can be done in UK????? PS...he is not a drain on society as he has his own money and would not be claiming benefits.

FYI yes I do know he would be shot, he has a warrant from Mugawbi because of his political beliefs, and also I have been with him for 3years what else do I need to know....most white on white relationships don't even last that long!!!

Why did he overstay the 2 years, it would have been viable for him to renew his visa in the first place.

The laws are there for a reason, and he has broken those laws already.

He will have to go back and to be honest to smend the mistakes that he has made, I would advise you to go with him, and make an application the the High Commission together for a marital visa.

There will be no way otherwise to do this unless if it is too dangerous for him to return to his homeland, maybe claim asylem.

In this circumstance he has to give very good reason why he needs to stay , and the reason he did not claim asylem at the point of entry.

Sometimes lokking into things for yourself can be really useful, and then in the long run, one does not get hurt or stung.

Err on caution please. Sorry to be abrupt, as a lawyer I have seen a lot.

Having money does not mean that people coming to this country are not a drain. There are other considerations to take into account. The use of the Health service..housing.. benefits if they are not working etc...
Unless you know a bent politician then Back he must go!

He should have returned and renewed his visa for 6 months when he had the chance....Unfortunately, you must have a social security number to get married legally.....Reguardless if he is a drain on society, he is now an illegal alien and if he gets pulled over, he will probably be detained, then deported.

Hi you need to speak to the Citizens Advice Bureau, if his visa is valid till 2009 there is nothing to stop you getting married here, why would he be in trouble if he goes back to Zim my friends and I visit every year it is tough but we have had no probs

If you think it's not safe to go back to Zimbabwe, maybe he could file for asylum...
If not, check what your immigration office says about marring a foreigner and especially one who overstayed.
