I have sole legal and physical custody of my son can i change his last name to mine even if the mother says no

I am guessing that he is also genetically your son (not that that part really matters but it will make a better case to a judge). You can petition the court for a legal name change. Get a lawyer...this could get ugly since the mama does not want his name to be yours. Good luck.

BTW I think a son should always carry the fathers last name (I know call me old fashioned).

Yes, I am sure you can change his name especially since it is his last name. Talk to the atttorney who handled your custody case or call City Hall or the City Court Clerk. I am sure they will direct you in the right direction.

If your name is on the birth certificate he should have your last name. Talk to a lawyer about it and find out your rights.

yes but he's birth name will always be on record.ask the court or just have use your name your the parent .he has the right legally to use your name.been there done that

No probably not. He can change his own name when he turns 18 if he wants to. But ask your lawyer or go to the court house and ask them.

No....as long as she does not agree and does not give up her parental rights to the child you can not change the last name....

You will probably need to go to a lawyer. They lawyer will give you a paper for your wife to sign. If she doesnt, you wil have to go through the courts.

If you are the father, you should not have a problem, unless your wife fights it.

yep talk to the judge to see where u can change his last name or search in google "change a child's last name" and make shure they have a license
