i was involved in an auto accident a little over a year ago. a lady hit me as i was exiting the frwy. the police took a statement for both of us. i explained in details what happend. her only comment was that she didnt know what happend. i had somebody in the car with me. all of us walked away with no injuries. the only damage to my car was a dent near the front driver wheel well and my door was dented just a tad. no damage else where. the lady that hit me was ticketed in the accident for failure to maintain her lane. she never showed for court. i was ticketed for no insurance. i was served papers today saying i being sued by the passenger, sueing for severe bodily injury. where that came from, i dont know. he is also sueing the lady that caused the accident. the atty. he is using contactedme the first week of the accident wanted me to start phys. therapy. i was not injured, so i did not pursue the case. what do i do, i have never been in this kind of situation before???

i have the police report... my bill from when i went to the doctor the next day to get checked out...nothing was wrong.... and pictures of the damage to the car. hardly any damage. hes broke and needs money i guess

Sure, he can sue you, but that doesn't mean he has a good case. I have good news for you, though....
Since the insurance company is the one on the hook to pay any judgement against the driver of the other car, they'll provide a lawyer for her case...they don't really want to pay this scammer, do they? If you offer the other person's insurance company some help with the case (testifying as to the lack of injuries, and the lawyer who asked you to go to unneeded physical therapy), they'll be on the same "side" of the battle that you are, and you'll probably get away with not having to pay a lawyer.
Call the insurance company, and they'll tell you what to do.
Shame on your trashy passenger. I could scold you for not having insurance, but you've probably learned your lesson the hard way, so I'll leave that one alone...just don't drive without it anymore, ok? Please?

Sure the passenger can sue you. Looks like that's what is happening now. Ordinarily your insurance would assist you in this situation, but if you didn't have insurance at the time of the accident, you are on your own for this one.
Probably you will have to appear in court, and probably you will want some representation, so as much as I hate to say it, you probably need to talk to an attorney. Was the passenger injured at the time? Do you still have access to the police report? You will probably need it. Sounds like your passenger is seeing dollar signs and has found an accomplice to help him.

I almost never advise this but here goes: you need a GOOD lawyer. Your passenger is simply reaching out in a pathetic attempt to make some cash, most likely encouraged or even begun by some slime-ball lawyer. Do not speak to or in any way have any contact with anyone involved in the accident without your lawyer's permission and/or direction. Don't sweat, it will cost you a grand for a lawyer but a good one will squash this vermin like a pimple.

well any one can sue you ,whether they can win the law suit or not that's a different story,,id get a lawyer ,and just go to court,,on this one,,that's all you can do,,but yes anyone who was involved can sue you,,but winning the suit is a totally different thing all together,all you can do is go and tell your side of the story,,i doubt that they win anything from this,,they waited a long time to sue,you,,and the judge will ask them why they waited this long also,,so id just go and deal with it,,and see what happens,,good luck with it,i hope this help,s.

you're purely in charge for the passenger while you're at fault, which as a effect your are actually not. in case you have med pay on your coverage it may pay the med costs for the passenger as much as the shrink you have.

You need a lawyer. You'll have to pay for this yourself since you were uninsured. Do NOT have ANY direct contact with him or his attorney!

YES get A lawyer. It doesn't sound like he has A good case, but it could cost you without legal representation. all so check in some states if you Winn you can get your expenses back from him.
