File, if you are due a refund, it is not to late. You have 3 years to request your refund...after that time you forfeit it. Now, if you owe, the IRS will catch up with you. The statue of limitations is entirely different if you fail to file. The IRS usually is around two years behind as far as matching data base with the Social Security Division...the Social Security Administration is the one that receives the information on the W-2 from the employer, not the IRS.

The penalty for not filing is almost always higher than the interest they will charge you... and it grows faster than you can possibly imagine... If you do not file your return by the due date, you may have to pay a failure-to-file penalty. The penalty is 5% of the tax not paid by the due date for each month or part of a month that the return is late...in addition if you fail to pay, you may have to pay a penalty of 1/2 of 1% of your unpaid taxes for each month or part of a month after the due date that the tax is not paid. Don't file a frivolous return either, as that will cost you an additional penalty of $500.00... GET TO A TAX ATTORNEY, not H & R Block... you need to get the ball rolling before they garnish your wages, or quite possibly seize your assets.... I.E. all the contents of your checking, savings and money market accounts... liens on your property and in the end, an auction of all assets to satisfy your tax burden ! Every day you wait... is another nail in your coffin !!!

I would contact a tax preparer and have them file your back taxes for you. There may be a penalty for filing so late but I always say better late than never.
