If he files as Head of Household he'd claim you as a dependent, which means that he'd get your standard deduction, so you filing separately would only increase what you'd have to pay in taxes as you wouldn't get any deduction. Unless you have children, that is. Then he would claim them as dependents. If you don't have any children, try figuring your taxes if you filed jointly, if you filed separately, and if he filed as head of household using your standard deduction and you filed separately with no deduction. Then determine which of the 3 ways would get you the most money back and go with that one.

No, a married person living with their spouse is never allowed to file as head of household.

Your lowest tax bill will probably come from filing a joint return.

Head of Household has NOTHING to do with who makes more. Head of Household is for people who are CONSIDERED UNMARRIED and have a QUALIFYING DEPENDENT (typically a child). This doesn't sound like you.

Married Filing Jointly gives you the lowest tax.

If you are married, your choices for filing are limited to married filing jointly or married filing separately. The majority of the time you are better off filing jointly.
