The kicker is that the hearing was over attorney fees he is being forced to pay for his ex-wife (in court for the divorce, child support, etc..) and he was not notified by the court at all. His ex's attorney called him yesterday to inform him that he'd be rescheduling it today because my boyfriend was not notified. Today the lawyer called back and informed him of the body attachment and warrent. How is this possible, and what should he do? How soon would you think they would attempt to serve this warrent?

A couple of notes: The amount owed is not for child support, it is attorney fees that he is paying for the ex-wife who left him after cheating on him. Payment arrangements have been made, and his is not falling behind on payments. The issue is that his ex-wife is no longer being a ***** and has jumped off her attorney's bandwagon. The attorney is now trying to escalate payment, when payment arrangements had already been agreed upon.

In the court records and your boyfriends documents there exists the planned schedule of payments. Secondly - not paying an attorney is a civil issue - meaning the lawyer by law cannot have your boyfriend arrested. He has 2 options file a lawsuit or send it to a collections agency - that's it.

The warrant is most likely a failure to appear in court. I believe that this lawyer is not being completely honest in the reason for the warrant.

Next time this other lawyer telephones your home instruct him to contact your boyfriend attorney - I am almost sure that your boyfriends attorney would want to know that opposing council is harassing his client

He needs to contact the court that the warrant is out of. He needs to find out exactly why they are issuing one for him, and if there is anyway for him to take care of it all without having to get arrested.

If there really is no way for him to take care of it without getting arrested, then he might want to see an attorney on the matter.

There is no real way to tell how long they will wait to serve the warrant on him. Some departments have specific divisions that all they do is go to peoples houses and arrest them on small warrants like that. But that is usually in larger cities though. They might actually just issue the warrant and wait for him to get stopped for traffic, and then the officer will run his name and it will come back with a hit on the warrant.

Either way, the best thing for him to do is to contact the court or an attorney as soon as he can.

Get his butt to court today and be prepared to pay. The longer he ignores the warrent, the more it will appear that he is attemtping to evade support. There is a child involved, and the court will take care of that child ... not your boyfriend. That being said, make sure he never misses a support payment in the future or another warrent will be issued. No child support means no drivers license... now how will he get to work???This is very seriuous s**t. Get to court. States have no patience with dead beat dads.
