I used to be a Texas PO. I am sad to say that you will find yourself serving up to 6 months in jail. The good thing is that most county jails are giving 4 or 5 to 1, meaning that for every 1 day you serve you will receive 4 or 5 days credit. More good news for you. It is not against the law to use drugs in Texas, only to possess them. There is not a DA in the State that will charge you for testing positive for drug use.
This is what your Motion to Revoke Community Supervision will say
1. Defendant has violated condition 1 in that the defendant has failed to obey the orders of the Supervision Officer
2. Defendant has violated condition 3 in that the defendant used cocaine on or about this date. Defendant tested positive for cocaine on this date.
3, Defendant has violated condition 4 in that the defendant has failed to pay court costs in teh amount of $xxx.xx
4. Defendant has violated condition 5 in that the defendant has failed ot pay court ordered fine in the amount of $xxx.xx
5. Defendant has violated condition 6 in that the Defendant has failed to pay supervision fees in teh amount of $60.00 for the months of September, October November, December 2006 and January 2007.
6. Defendant has violated condition 9 in that the defendant has failed to complete 10 hours of community service each month for the months of October November, December 2006 and January 2007.
Community Supervision officer Fish recommends that probation be revoked and defendant sentenced to the maximum term allowed.

If you don't successfully complete your probation, you have to go to prison for the amount of time the judge specified when you were sentenced. If you fail a drug test, that will be an additional charge, and the time will be added to the time from your first offense.
Two more months? I'd keep it clean if I were you. If you say you "can't", then do your time. You deserve it.

Well it seems your PO has already informed you. What do you want to hear?
Don't sweat it. These are all empty threats from your PO. Don't waste money on fines, instead buy more cocaine. How's that?
Also, it seems you have the community service covered as "i have NOT done NO community service" would indicate to me that you have done community service.

Too late. Don't worry about being released from probation...that isn't going to happen now that you've tested positive for cocaine.
You will get your back up time from the previous crime AND the time they give you for the new felony.

I think your probabion agreement probably listed what you'd face - jail, if you didn't comply. And why haven't you, it's not like you're on a chain gang or stopped from leaving your home except for necessities. Get your act together and do what you're supposed to do , get off drugs and use your time wisely to benefit you and society. Is that so hard, huh?

I don't understand why you didn't accept the terms of the probation and get out of this mess the easy way.
Sounds like you have violated the terms of your probation and if you don't work it out, you'll have it revoked and that sounds like it could be serious jail time
Be smart; deal with it.

Why? You think your PO is lying to you? You will have to serve the original sentence you are on probation for and you will face the new charge(s) on failing the drug test. You asked for it, now you will get it. I hope you like what they do to dumb newbies in TX prisons!

you are screwed...if you'd pay your fines and court cost the PO would propably not even make you come in anymore..they wont tell you that..and then you wouldn't have had to taken the test...yes they will probably make you do some time
