what i am trying to say is i have a first degree misdemeanor but i dont have a record could i still get jail time even if my public defender is going to try to get it dismissed

Any conviction will have a record. Some can be concealed from public record because of age, being a Kennedy etc. You have to gives more information on circumstances of this misdemeanor conviction to help out.

If your a Kennedy don't bother we all have heard it before.

Is this a question referring to someone receiving a "First Degree Misdemeanor" conviction despite no criminal record?

In my own jurisdiction we refer to the classification as a "Class A Misdemeanor.'

Every crime has what's referred to as the "elements of the offense." Someone did something....the results of what someone did broke the law!

If convicted of breaking that law then there is a specific punishment set by law. It doesn't matter if you have a clean record or not!
