Is it true after residing in US (coming from Germany) and being married for 5 years to an american citizen (living together) with child born in US, without applying for citizenship, that you become a legal alien resident? If so, what rights do you now have..ie can you apply for a job?

If you never applied for an immigrant visa and never applied for permanent residence status once you got here then you're an illegal alien. If you are married to a US citizen and have a green card for 3 years then you can apply for citizenship.

No. You should be a legal alien resident from the moment you live here. Then, after five years of living here, and not having been outside the country for more than six months, you are eligible to apply for citizenship. I am from Germany myself and have just become an american citizen, but I have dual citizenship because I applied for that with the german government. YOur child is already an American, being born in this country.
I married and American and had to apply for a green card which then allowed me to legally live and work in the US. That my husband is American only made it easier for me to have been granted the green card. Without it, married or not, you are considered illegal, unless you have some sort of long term visa. You can only apply for a job if you have the green card in your possession. Most employers, if they are ethical and lawful, will require you to submit a copy of it before they hire you. The applications will ask if you are a citizen or legal alien. Then you have to enter your Alien number.

Living with a US citizen does not give you residence, you have to be married and apply together to receive your residence, after applying you get your work permit in 2-3 months (or less), if approved a temporary residence is given to you and in 2 years (when again you have to apply to remove the Temporary residence) you get the permantent residence.

No. human beings get married each of the time wondering that is real, although that isn't any longer. The unlawful alien nonetheless has to bypass by ability of the proper channels to both develop right into a criminal resident or a citizen (that are 2 diverse issues).

No it is not true, anyone who wants to be a citizen has to go through the proper procedures to become a citizen just like everyone has to. You have been here for 5 years and haven't worked?

Yes i think you became one once you got married and were together for a really short amount of time. But you may want to contact your local court house to be sure.
