If you have anything in writing- a contract- a scope of work- a proposal, anything you need to read his payment instructions. A contractor can file a mechanics lien if you fail to pay him for any work done to your home.

Reread the contract, if he has complied with it, you should pay up regardless if you think the job is done or not. If he hasn't completed the contract, don't pay but besure to show up at the hearing prepared to present your case.

Unfortunately many people hire workers to do specific (in their own minds) work, then sign a contract that does not describe all that is to be accomplished or sets out payments that pay for the work before it is completed and they are stuck. A good rule of thumb is to not make progress payments unless progress has been made. Another is to have a neighbor or friend read the contract and make sure that it accurately describes what, when and where the work is to be done.

Good luck and be sure to tell ten others what is happening to you, why it happened and how it was resolved. Be fair.

Goes to the courthouse and files a lien/asks for a judgement agains the property. Mechanic's liens will take presidence over almost all other liens including the mortgages on the property in many cases.
