it depends if she has a will there will be an heir.
But if she has no will it will be subdivided to her relatives beginning with her immediate family that is her husband then her kids and then her relaitives.
But in most cases it is her husband who gets the wealth cos there was transfer of property from your dad to your sis and then to her husband

is this your sister's son? you say brother-in-law.
i would think your sister would have only the rights unless the will included her children.
how old is the son? your sister has the choice if its her son.
