me and her father live together although not married.I usually dont work but have earned a whopping 500 dollars this year-my guy makes tons of money...who would get the most return for claiming her? also I havent done my taxes in years-since I havent earned anything-will I get in trouble for it?

Your guy should claim her.

Assuming that you even had to file, you would be in the 10% tax bracket. If he is in the 25% bracket, her $3300 exemption alone would be worth $330 to you but $825 to him, and that doesn't even include the state tax.

If you are not earning any money at all, there is no need to file tax returns. That is based on not grossing any income, and not what you make minus what you are spending to make it. If you were earning significant amounts of money you should file your prior returns. If not, there is no need to file.

I have to recommend that both you and your daughter be claimed as dependents on his return. He is obviously supporting both of you. If you haven't earned anything you aren't required to file a return, so you won't get in trouble for "not filing". You aren't required to file if your earnings were only $500, unless you have money withheld for FIT and want to get it back. You can do this and still be claimed on your boyfriend's tax return.

You could also file a joint return as common-law spouses with a dependent child.

I don't think you even make enough to file. He would get the most return.

your guy should claim her since he provided the "main" income and if you havent worked than you dont need to file.
