The legality of it depends on the state. I *can* tell you it's illegal in Oregon and California and can warrant the entire place being closed down and personal liability for you (especially in CA). If you aren't sure about your state laws, call your local Alcohol control board and ask them.

As far as you getting "wasted", this is also probably illegal. In many states, it's the responsibility of the establishment to not serve anyone to the point of being "wasted". In CA, if you drive home and get in a wreck, the establishment can be sued by BOTH parties.

It's not cool if you are driving home, screw up checks, lose money for the company, or make a fool of yourself. A bartender should be sober to ensure that everything is going right in the bar.

If you're comfortable with it, I think its cool. I think its a great way to socialize with the guests and get them to (a) leave you great tips and (b) come back again. I'm not sure about the legality of the situation. I think as long as everyone makes it home safely at the end of the night then there is no liability issues. Sounds like a fun job!

Ya, well, it's cool, it's legal (over 21) but it's not very smart or professional.

Look at it this way, your patrons come in to see you, have fun & relax. They "expect" you to look out for them.

You, as a bartender, are responsible for these people that come in--how much they drink, & if they're regulars, how much they have drank Before they got to your place, & how drunk they are when they leave. YOU are responsible, as is the owner of the place. Be very careful, if someone (anyone) even who you think would "never do such a thing" sues...big trouble for you & owner. The alcohol part is 50% of the business. Respect yourself & your place of business. Don't get stupid.

If you are under 21 it is illegal. If you are drinking while on duty, it is usually the norm not to. It is definitely a safety factor, not to mention the negative effect being "wasted" undoubtedly has diminished your attention to detail concerning your duties. Why not find a happy medium and save the real drinking for After work. Your boss may Likes you to participate in drinking, but your question on this forum reveals to me that you are becoming a self-thinking man.

You work alone! You are gaining respect for the working man.

I never met one bartender that didnt drink on the job. Its up to the company you work for on there policies about drinking on the job. So I don't think that it is illegal.

Just make sure that you're not too drunk to keep tabs on the money and the alcohol (in case something comes up missing!) It might be illegal in your state to drink after hours even if your boss is there... Have fun, but be careful.

legal? depends in what state you are in. cool? no. as a bartender you have a resposibility to the customer. it is for us to watch them and make sure they are not wasted. alot of states have a 3rd liability law that says" if any patron leaves a bar and causes an accident, the bar and bartender are liable" look it up its called the dram shop law act.

the ABC came into our local pub here in so cal. and shut it down for 30 days because the bartender was drinking while working. The owner says the fine is big enough he may not reopen.

Jeez, it can't be very smart.

Why don't you do that little trick they showed off in the movie "coyote Ugly"? Keep an empty beer bottle handy... "drink" a shot, follow it with a swig from the empty bottle. Discreetly spit the shot into the bottle and you can stay sober, collect the tips form customers who think you're super cool, and keep your moron boss happy.
