I live in a small town where big trucks, big motors, and fast cars is a cool thing. I live abt. 10 minutes from the river bottoms where one day my fiance', me,and two other friends were on our way to the mud holes in our jeep. While riding to the gravel roads we had a convertible camaro come up behind us fast and revved his motor and then passed us in a no passing zone. After he did that he slowed down really agging us on but we just passed him and went straight on to where the gravel road began and he tromped down side ways and went around the curve on blacktop. Half way throught the bottoms a sheriff car passed us then turned around followed us abt. 1/4 of a mile then pulled us over cause the off duty officer said we were driving crazy and drinking granted my fiance had just started drinking cause we wasn't coming out of the bottoms we was just muddin and gonna camp there. They charged him with a dui however when they did the second test at the jail he wasn't over the limit?!.

AFTER BEING TAUNTED BY AN OFFICER WHO WAS DOING THE WREKLESS DRIVING PASSING IN A NO PASSING ZONE TROMPING HIS CAR SIDEWAYS WANTING TO RACE AND WE DECLINED WE DID HAVE BEER IN A JEEPWITH THE TOP OFF SO HE SEEN IT AND WE WERENT EVEN ON A STATE ROAD WE WERE IN THE RIVER BOTTOMS ON A GRAVEL ROAD

what you people must be missing in the story is the fact a cop was driving the camaro too.

No entrapment here. Anybody, even an off duty cop, can call the local police agency and report a reckless or drinking driver. The officer who pulled you over undoubtedly did some preliminary field sobriety tests before arresting your other half. Here in California (and in many other states) there are two levels of DUI, one where you are above the legal limit and one where you are driving while impaired regardless of your BAC. If your fiance was impaired, regardless of his blood alcohol level, he can likely still be arrested for DUI.

Remember that entrapment is when the police encourage you into criminal actions that you would otherwise not have taken, then arrest you for those actions. Let me try to present an entrapment situation close to your situation.

You and your boyfriend are at the mud hole sitting in your parked car. Your boyfriend has had several beers and does not want to drive because he is intoxicated. A police officer approaches and orders him to move the car. Your boyfriend protests due to his intoxication but the officer is adamant and your boyfriend eventually concedes, get in the car and drives away. At this time the officer pulls him over and arests him for DUI. THAT would be entrapment.

What you have represented is nowhere near entrapment.

Where's the "entrapment"? If the fellow in the camero called in a report about your driving, that is not entrapment. I assume the arresting officer did some kind of preliminary test before arresting your boyfriend. The "field test" is presumptive, the test at the office is the one admitted for evidence in court. Since your boyfriend passed that test, he's home free.
According to your narrative there is no entrapment.

i ask your self if he thinks we are that stupid or what. i imagine his intentions are to grant illegals the right to vote hoping they are going to vote for him and his demonic party at any value to something else individuals. he's an evil guy with a hellish time table. i'll claim he fooled a mess of human beings in '08 yet no longer all individuals. Our in common words desire is to reject his henchmen, henchwomen interior the autumn and in '12 reject him out right. it would want to come to taking to the streets to get our usa lower back.

O sweet jesus...At what point is that entrapment?...You stated the state's case. "PLZ I WAS JUST MUDDIN AND THAT GUY PASSED US!" Gimme a break. You broke the law and got caught and he didn't. Show some sack.
