My fiancee has hired a US atty to handle our case, I have asked him if the they emabassy will contact my kids father in the future, all he said was PROBABLY, I was hoping that he could give specific answer to that, so I consulted a local atty instead, and they said the embassy will not have to contact my kids father coz we are not married and he has no legal rights..my question is why is it the US atty has a diff view on the matter and that the local atty has one too, which is which I should believe???help pls....thank u

There is no set formula. The interviewing consular officer will ask any questions, conduct any kind of investigation, and review any evidence that seems appropriate in order to make the correct decision. This might or might not include talking with third parties - although it usually does not, since we are very careful with people's privacy. Most K1 visas are straightforward and simple, and the decision can be made in minutes; some are not. No one can predict exactly where the interview will go until it begins.
