I took over some property about a year ago, and there has been an abandoned car sitting on it since I've taken over and I have heard it's been there for about 8 years. Anyway, How can I legally posess that car? I do know the guy's address, and It's out of town.

call that guy and ask him to move the damn car!!! and if he dosent move it, call the cops and saying that theres a damn car in my yard!!!, then the guy have to move it with court orders...

and if u want to keep the car, goto secretay of state and tell them ur situation, they will know what tto do....or go find the owner of the car and ask him to sell it to u

You didn't say what state you are in but here is a general outline

1) You can not simply own it... you need to send a letter to the registered (and legal if different) owner(s) of the vehicle that:
a) Tells them the car is parked upon your property without permission
b) You are not responsible for the care and safety of the vehicle
c) Request that they promptly remove the car from your property
d) Inform them that after a reasonable date (set one that allows for them to get the letter and respond) you will be charging storage at a certain rate.

After that happens send them a bill after a month

If they do not pay the bill you can now lien the vehicle but this can be an expensive process depending upon what state you are in. For example some states require that the vehicle be towed to a designated lot and then auctioned off. Guess who pays the up front costs? At this point you need to reseach those specific laws to find out what to do and how.

It might be better for you if the car were simply 'stolen' after you send him the letter and then recoverd on a public street. Maybe you can hope that will happen.

The laws vary from state to state. If you just want to get rid of the car, call a towing company. They should be able to tow the car away at no cost to you. They will either recover their fees from the owner, or, after 30 days in most states, file for title for non-payment of storage. If you want the car for yourself, this would be a good time to get it. If not, just let them tow it off and deal with it themselves.

"PARKED UNAUTHORIZED, UNATTENDED OR BLOCKING PRIVATE PROPERTY: Vehicles cannot park in private property parking lots, driveways, or other spaces unless authorized (like tenants or customers) or without the permission of the property owner. Private property must have specific signs at property entrances and vehicles must be parked in violation, according to the vehicle code. Police officers may also remove vehicles from private property in some circumstances. Vehicle towed or removed must be reported to police. Property owners can call private tow companies and tow vehicles immediately, per 22658 (a) CVC."

If you know the guy's address send him a certified letter telling him to move the car within 30 days or you are going to have it towed and then sold at auction.

I'm sure if he cares about the car he will respond.

If not, tow it and sell it!

It's upto you if want the car for your self you have to get in contact with owner but if not best thing is to have it towed off and save yourself alot of B.S. Good luck.

Depending upon your state's laws it could be 30 days to 90 days, but you should beable to find out using your computer for your state's regulations.
