Depends on your local state and county laws, but I've seen it charged as either a violation or a misdemeanor. Sometimes the actual charge is "harrassment," or something like that.
And if you spit on a cop, charges can be more severe.

In short, yes it is illegal depending where you live and yes you can be sued for it...Keep in mind that most states in recent years have adopted criminal statutes pertaining to battery by bodily waste or bodily fluids...And anyone can sue just about anyone else for anything..civil requirements are much less stringent than criminal..So keep your fluids to yourself....

You can be arrested and charged with Battery. If you have HIV or AIDS thatr can be considered a deadly weapon and you will go to jail for a long time.
