For prescribing unnessasary painkillers....therefore contributing to my husbands pain killer addiction??
He has only seen my husband once and didnt even ask questions when asked for the scrips...

Basically... You husband being of sound mind and body had a choice...

Pain management is difficult because it is hard to tell if the patient is just a pain head or really in pain.

Don't blame the doctor... Too many people sue, too many people do not take responsability for themselves and are always fast to blame. If it weren't for people like you... there wouldn't be a need for so many leeches in the form of lawyers.

One leech feeding off the other if you ask me.

Tell him to buck up and get off the junk! Even in AA or NA the first thing they will tell you is if you took it... You are responsable for it. If you abused it... that was your choice!

Im sure that your husband is not a child... and although in pain, we still have choices that we make. He could have been a little more involved in his therapy if there was some concern, how come you didn't stop him when you saw it becomming a problem? How come you didn't ask any questions until it came time to sue?

Don't make such a joke out of yourself please! Be real, get him help and get over it!

This is coming from a person who is not too keen on doctors too so...

You have to prove malpractice and that won't happen. Many people can become addicted to ANY type of pain killers. The doctor has no way of knowing who will become addicted and who will not. When it was suspected, then your husband should have talked to the doctor for another option. The doctor prescribed the meds based on his knowledge of the pain. The rest falls into the hands of your husband. You most likely will not win nor even find an attorney to take the case. But seek an attorney to be certain.

You can start by filing a grievance. It would be pretty hard to sue him unless he had information that your husband was addicted before and he still prescribed to him or if it was grossly inappropriate medication, etc. Also, your husband is an adult and the doctor/patient relationship is private. You may wish that he hadn't prescribed the pain medications, but if ther doctor and your husband acted in good faith, there's no case.

I would start by filing a grievance with the AMA or your state medical board. They will hear the evidence, make a judgement mete out punishment, if any. If they come to the same conclusion as you did, you then would have reason to sue for criminal negligence or malpractice.

Your husband is the only one to blame for his addiction. blaming anyone else will not help him. call NA
