In order to pursuit legal action against any physician, hospital, etc you have to prove 4 things.
1. duty - did the physician have a duty to the person (in your case, yes, because he agreed to write him a script)
2. breach of duty - did the physician breach his duty? Meaning did he act negligently or exhibit gross misconduct? - maybe
3. damage - were there damages? - maybe
4. causation - did the breach of duty cause the damages? maybe

All four questions have to be answered yes in order for the lawsuit to be considered "having merit". Once it is meritable then it can be action can be taken (lawsuit filed).

which will be demanding to educate. Why did he see "this" MD ? you're saying he's been addicted for 20 years, how come not something changed into "carried out" earlier to now? Why do you're saying "unnecessary" discomfort pills ?did you recognize for a fact,he's not having discomfort ? The" new " time-honored practitioner somewhat isn't at fault he's purely considered and prescribed for him once, were you cutting-edge contained in the exam room at the same time as he changed into examined ?there'll be many many questions like this from a legal specialist, now to not indicate the "Malpractice" specialist which will decrease back up the MD in question.it will be a foul affair, truthfully, the state medical board receives in touch, and it is accessible you would possibly want to be at fault for supporting and abetting your husband's dependancy. If the courtroom reveals this MD danger free of your expenditures,he then can turn round and sue you for "Defamation of personality",for causing damage to his practice and attractiveness etc. in the journey that your husband is" Dr hopping" going to many medical doctors over those 20 yrs,it isn't in any respect the overall practitioner's fault, your husband is committing the "fraud",with information from being dishonest,it is not the overall practitioner's position to provide his pt's "lie detector tests" or employ a private investigator to be certain the fact. Of course call a lawyer first, but you may have to start with the board of medical examiners in your state. Be prepared, they will back up their boy and try to paint you as a wacko. I once went up against them when my autistic son was mal-treated

My Uncle is addicted to Oxycontin and morphine and it is shocking how easily he gets it, and all legal.
