His father and I have been divorced since he was 2yrs old. We also have a 13yr old, who after a custody battle last year was scared by his father into living with him on a 1yr trail basis. We are to go back to court in April for a review and he has already starting the mental abuse. He tells them if they don't want to live with him he won't take them on vacation, or hunting, etc. He bought them both dirt bikes for Christmas which he is now threating to take back if they don't both agree to live with him...I could go on and on about his little tricks. Any suggestions would be great!

I personally don't think it should be left up to the children on who they're going to live with. It puts too much pressure and guilt on the child, no matter who they decide to live with.
This is a case where you & your ex have to either agree on a suitable custody arrangement, or let the courts decide.
Having lived through this dillemna myself at the age of 10, it's a complete no win situation for the emotional well-being of the child. No matter where they choose to live, they're hurting the other parent.

Does your son see a school guidance councilor? If not, I think you should request it. If he reveals this info to a person of merit, the school can talk to your husband about his behavior. He's not going to listen to you, but he might listen to the school. How awful for your son. Best of luck to you!
