In the law unless otherwise stated by the courts the mother is the default parent. You should approach your "girlfriend/wife" in a mature manner and try to work out some sort of visitation schedule and Child Support. Always have proof of any money you give her. If it's a check, write Child Support in the left hand corner.
Since she is with her mother, she has temporary custody. You can't just take her and say you have custody. You would be charged with kidnapping.
If your girlfriend/wife refuses to cooperate, I'm afraid you'll have to get an attorney. Try calling Legal Aid, they can represent you for free, if they take your case.
If she's a good mom, you'll at least get visitation. It sounds like that's what you want anyhow.
Do get an attorney. Find one that will take payments.

Your going to have to go to court. Plain and simple, there are attorneys who will do this on a sliding scale etc. If you just go get your daughter and she has not been living with you all this time and you were never married to her mother you may find yourself in some legal hotwater. Especially if you haven't contributed to the welfare of your child in anyway.
Get some legal advice before you do anything. If you just go get her the courts may not look upon you as a responsible Father.

When you get your daughter in your custody you don't have to return her, you can hold her until the mother takes you to court, but this can traumatizing to the daughter. Sorry to hear about your situation good luck!

their is free legal service in most urban areas.....call your states bar (lawyer) association..............
having your daughter in your possayion is not legal custody
does you wife dispute it.....is she safe....if not report to child services....but it has to the truth
are u on the birth certificate.......if not why.....
