There are several legal paths for situations involving domestic violence.

The first, and the one perhaps most people think about, is criminal law. The Crown can charge the offender with a crime.

The second is in the realm of civil family law. This involves a plaintiff (the abused person) seeking court orders to protect their rights against the abuser. This may include divorce and custody actions, orders seeking possession of the matrimonial home, injunctions against harassment and so on. There are also statutes such as Alberta's Protection Against Family Violence Act.

Depends on where you live. Typically the abuser is arrested when there is evidence or an accusation of a physical confrontation or the threat of physical harm. Unfortunately, the abuser will only spend one night in jail awaiting a JP to set the bail or release conditions. I have first hand experienced domestic violence and feel the laws are not near tough enough to protect the victim from continual violence or worse yet, becoming victims of more violent acts. Good luck! If you are a victim, help yourself. You need to suck back the fear and pack up your things and get the hell out. Don't do the "I feel sorry for the person" thing to yourself, trust me. It will set you free.
