In some cases, like if the State has your kids, they can terminate your rights and then they have to have your consent to adopt out your kids. If you are the dad and mom is remarried, then she has to have to have your consent unless you have not paid Child Support AND failed to have contact with your child for at least a year.

Dads disappear out of a childs life, mom remarries, dad ignores any contact for custodial rights, step-dad gains legal custody by default. But it takes a while to prove that dad can't be found.
