Moves in. Doesnt pay rent. Isnt on my lease. Moves out after 3 months. Leaves most of her stuff in my garage for the past month. Now wants it back. What legal right does she have? Some stuff she is claiming is hers...isnt! Having Dad pop in a few weeks from now to load a up his truck. I want to lock up my garage, and bust a cap in Dad if he sets one paw on my property. Whats my legal rights? She had her mail transferred here and thats it!

Sounds to me that you had a long-term guest rather than a tenant. Just for the sake of courtesy, I'd let her and her father pick up her stuff from the garage (what do you want with it?). If you're worried about your belongings going, errrr, "missing" during that time, why not just pull these things out and store them elsewhere for the moment?

Was the she a girlfriend? If so, it didn't work out for the two of you, so let her get her stuff and call it an ending. Your legal rights would probably be that you allowed her to move in and never made any formal arrangements regarding sharing the rent, etc, so she should get her things back. But even more importantly, it would be the adult thing to do. Move on and let her do the same.

That's all she needed for proof of residence in 48 states was her mail being forwarded to your address.

She didn't have to pay rent...as the courts would see it, she was a live in domicile, whether you girl friend or not. Hard to disprove a false positive.

Give her the things you know are hers. Anything else, tell her to take you to court. Do not make threats. You stating "I'd liked to bust a cap in DaD" is a terroristic threat. If she read that online...you'd be looking at time.

Its not worth the hassle. Put your chin up and take it, and live by a lesson learned.

You didn't have to let her move in, but you did. You didn't have to store most of her stuff in the garage, but you did. Now, she wants it back. Let her have it. You don't need the stress of storing her things for her. Legal rights? Probably none, but what of it? Her stuff, right? Let her have it.

my question is why would you have some of your stuff out there stored with hers? was it bought for the house when you were living together perhaps as a couple? that why its out there?
If it was yours why did you let it go out there to begin with? sounds weird to me.....and they say nothing like a scorned woman......xmmm works 2 ways me thinks

Yours by possession, but be fair and put her stuff to the curb AFTER you tell her the day and time. Law will side with you.

she was bascially a friendly squatter and has no rights. if there is no legal document(depending on your state)she is S.O.L.
donate or toss her junk and tell her to stay of property or you will call the cops.
