I need help in, say if I pass over and don't make a wil what will happen to my money and assests will my next of kin receive it? or will anyone in the family eg mother brother father can they claim my stuff? Real answers please.

It varies from state to state, but in general: First your children and/or spouse, then your grandchildren if any, then your parents, then your siblings, then grandparents, etc., etc.

Legally, YES your mothe or brother could claim your items. However, if you have a bank account and they are NOT on the account, they would not be able to close out the account without showing a death certificate. Even showing the certificate, they would NOT be able to get the money unless 1-they are on your account, or 2-it is in a will (power of attorney would NOT work because once you pass on, the power of attorney becomes null and void)

They would be able to do what ever they want with your items; however, as an example, lets say your neighbor Phil comes over and says, oh no, she left that to me. He legally could sue them in court because there is no will stating what you want to do with all of your things.

This is a real answer.

You MUST see a Lawyer within your state to ensure all your concerns are addressed.

No Will = Somebody like a Judge who doesn't know you ending up making all the decisions. And, it's not all to your advantage.

I just went through this whole problems with my dearly departed wife. Listen to me closely, IF YOU LOVE YOUR FAMILY MEMBERS, get a will and all of the appropriate docs to go with it. Don't forget the power of attorney and living will and maybe even and trust. Make certain you have everything covered that pertains to your death. Durable powers of attorney are great. Remember, if they love you and you leave them powerless to end your suffering your hurting them. Good luck
