Well, this is all speculation....but here goes:

The only way she could legalize same-sex marriage would be to make a special presidential mandate..which she would not do. Other than that, she has no powers to make laws.

The congress would have to make and pass a law, and then she would be able to either sign it or veto it. She MOST CERTAINLY would sign this law and approve it, if it reached her desk from congress!

So, the answer to your question is sort of yes......but it would have to pass through both houses of congress first.

In 2008 she will still be a U.S. Senator, and the only thing she'll be able to do from inside the Senate is to introduce a bill to do that and then to cast 1 out of 100 votes on her proposal. After the 2008, if she's elected President (a very big if) then as President she'll have even less that 1% of the power of a Senator.

The only way she could legalize same-sex marriage as President, is by appointing gay-sympathetic people to the Supreme Court. THAT is what we should be worrying about.

All of the comments are right--- Hillary could not, herself, make a law "legalizing" same sex marriage (a) because as president she cannot make a law (although she can propose one and can sign a bill from Congress) and (b) because marriage is almost exclusively a state law forum; outside of appointing hyper-hyper liberal justices to the U.S. Supreme Court who would then rule that the federal Due Process and/or Equal Protection Clauses REQUIRE not only same sex unions and benefits, but a civil "institution" called "marriage" for those of the same sex (HIGHLY unlikely considering the level of academic discourse in the federal courts today and Hillary's suprisingly centrist attitudes), it's not going to happen.

The President alone doesn't have the power to do so, but to answer your question, legalizing same sex marriage is not nearly as much of a priority for Democrats as banning it is for Republicans. Democrats are generally content to leave the issue to for the voters of each state to decide.

honestly! Why shouldn't gay human beings be held to the same criteria as immediately? also, there are countless childrens available who favor adoptive dad and mom and that's a lot less stressful to undertake with that marriage certificate.

I think marriage laws are governed by state law so that would not be easy. Not too worried about old Hillary having an option in any case.

If you knew anything you'd know that marraige is a STATE issue.

I am very active in Democratic politics, and I have yet to meet anyone that has same-sex marraige on the agenda.

It's completely dreamed up by Republicans because they can't run on their actual policies.

I can't stand her but I think same sex marriages should be legal and allowed everywhere...who ar we to judge?...

If elected to the presidency she will not be a legislator.
Even if she is elected to the Senate, she can't do it by herself.
