What reason did they give for your termination?

Can you prove it? Is this the reason they gave you? What reason did they give you? You can sue but you would need to prove it and make sure they do not have other grounds. I will give you an example. If you were late 8 times last month and they fired you then you were fired for attendance. If your cowoker showed up late 9 times last month and she is still working there and other than that you have similar performance at work then you would have a better chance of convincing the court you were fired for some other reason.

You can sue for discrimination, but before you go through all the trouble, do make sure you have some evidence. By evidence, I mean proof that these thing were done to you, including witnesses, letters, e-mails, voice messages, and examples of others at your same capacity and skill level that were treated better because they are different than you. Otherwise, you may be going through one big headache for nothing.

Depends on where you live, if you live in A Right To Work State, like Wyoming & Utah I don't think you can sue. But I'm not sure. In a right to work state, they don't have to tell you why you were fired, & you can be fired at any time, unless the company you work for has a different policy.

How were you wrongly fired? Also, do you have proof/witnesses? The reason I ask for proof/witnesses is because your track record will be looked at, which it is your word against their's.

P.S. This is a tip for everyone. Once you start working at a job, keep a blackbook. Any job I start working, I take notes on everything and everyone I come in contact with. It just takes thirty minutes or less a day to type the information into your computer after you get off of work. It is protection incase of being fired for no reason or due to retailiation.

Has anyody seen sitting down with the hot boss and discussing the subject??? whilst will you human beings study, you don't get what you % or deserve by using stressful or threatening to sue. You negotiate what you %. once you negotiate , you attempt to create a win-win siituation. Has every person tried to convince him that this could be and previous rule which not has everywhere interior the workplace and what hewould income by using not imposing it??? I doubt it, because of the fact your first question is "am i able to sue?"spectacular away, you create a unfavorable ecosystem wherein any hazard for negotition is thrown interior the trash.

That depends on many things. You didn't give many specifics in your question. How were you discriminated against ? What did whomever fired you actually give as a reason ? Does your weight negatively impact your job performance ?

In most cases, if your former employer can prove adequately that your job performance suffered as a result of your weight,
they can fire you because of it.
Especially, if you didn't ask to take your 12 weeks of unpaid
FMLA leave to lose weight. Obesity is rapidly becoming known as a disease.

if your weight was keeping you from performing your duties: yes; like everyone has said before you have to prove it, which will be hard since they probably thought of an extra reason to fire you just so you couldn't sue for sex/weight discrimination...and unless that they fabricated that and you could prove it then you are out of luck. good luck though

FYI, its "discriminated against", not discriminated...

If you were fired for your gender, yes you can attempt to sue. It does surprise me that someone who would HIRE a female would then turn around and fire her because she is female... Are you just guessing that that's the reason?...

When have we heard that before, everywhere. No one admits truthfuly that they deserved to be fired. It is so easy to play the victim and blame someone else.

I assume that you were the same sex and weight when you were hired. What changed? Or was it discrimination when you were hired too?

Maybe. Just because you believe you were fired for that reason does not mean that you can prove that you were. I suggest you speak with an attorney in your area to see if you have a case. I can't help you without more specific details.
