last july i was on a friends speed boat with my husband .we were on the back with a tube the guy turned the lake to fast and before i new it i was up on the bank on a hill of rocks i hit doing about 40 miles an hour. it tore my leg and back up i was lucky t be alive. i was just so fritened that i wanted to get up out of the place i was at and go home not thinking of the medical part but know a few months later i have a scare up my leg and on my back and i have back trouble what should i do?

First of all no one here is a lawyer. Secondly, each jurisdiction has its own statute of limitations. Next, did you go to a hospital or were you treated by a doctor? (I hope so). July was nearly 8 months ago. I should hope you have been under the care of a doctor, or at least that you have been treating your injuries yourself. Also, I assume you have the name of the person who caused the accident.
Regardless of the circumstances, you should seek the advice of a lawyer. He or she can help you regarding your rights.

Sorry to hear about your accident. You're right - you're lucky to be alive! Anyway, if I were you I would sue. The statute of limitations on personal injury is at least 1 year (in some states more) so if you are talking about July '06, you still have time. Your injuries will probably require extensive and expensive treatment, and it should not have to come out of your own pocket. I know you are probably reluctant to sue friends, but this will be turned over to their insurance company, and will not be a financial burden on them personally (just like a car accident). Get a lawyer to handle this for you. He should be willing to take this on a contingency basis so you will not be out-of-pocket for anything except a few up-front expenses. Hope this helps.

Hope you have insurance because it is now too late to claim on the incident. You have like 72 hrs to say that your injuries came from a certain incident longer than that the insurance companies can claim you did it doing something else.

Now as to your injuries, go to a doctor and get a full exam. You might need some plastic surgery, they can clean scars up pretty good nowadays. Your back pain might just need steroid therapy but you should get an x-ray to see what it looks like. A doctor can tell you a lot more after a physical exam. Don't go to the ER, it has been too long and a doctors office is way cheaper.

Whatever you do, do it fast ... there is a legal statute of limitations on this. You also have to get your witnesses together. I am not saying that you have to be mean of confrontational, but people become weird over things like this. If you have damages caused by accident or negligence you should get them looked after.

Have you been to a doctor? If this story is not corroborated or reported you may be out of luck and your friend of his boating insurance may not be liable for anything.

I would talk to a personal injury attorney ASAP. Remember that he may see the case as only a way to make money. Find out what your damages are, you may be able to sue in small claims court as well and not involve and attorney.

Most important thing, get medical attention.

You can sue your friend for negligence. But then again he will have an attorney that says you were just as responsible for being negligent riding an innertube being dragged by a speedboat.

You can ask if his insurance will take care of it. I doubt if he even has insurance for boating.

You can live with the pain and never do such a thing again.

If you had an actual case with real information and witnesses you would be talking to a lawyer, not us.
